1. What does ezyHire do?

ezyHire is headquartered in the United States and has offices and group companies located around the world. ezyHire provides an end-to-end hiring platform that offers a seamless recruitment experience at every stage, across multiple channels. This platform is deployed on third-party websites or mobile applications that belong to our customers (“Customers”) and allows our Customers to efficiently manage and verify the identities of candidates or users (“Users”). ezyHire also offers ezyHireID, a direct-to-consumer, streamlined identity verification platform that allows users to securely verify their identity with companies that accept ezyHireID. Additionally, ezyHire provides advanced features such as background checks, photo ID verification, assessments, live interviews, AI-driven candidate screening, automated interview scheduling, and in-depth analytics for optimizing hiring processes.

2. What does this privacy notice cover?

This Privacy Notice covers our collection, use, and disclosure of personal data that we gather in the usual course of business, for example, through our website at ezyhire.com, including its subdomains such as docs.ezyhire.com (the “Website”), when you access or use ezyHire's platform (the “Products”), through responses to surveys or questionnaires, when you send us an email or otherwise contact us, or at offline locations and events (all together, the “Services”). In such cases, we act as a data controller of your personal data.

Please note that we also act as a processor when providing identity verification services to certain of our Customers. This Privacy Notice does not apply to the personal data that we process as a data processor on behalf of our Customers in the course of providing ezyHire's platform. In those cases, we invite you to contact the relevant company or organization if you have any questions about their privacy practices.

We may provide you with additional privacy notices depending on how you interact with us and depending on the type of personal data we collect.

3. Sources of personal data

We may obtain your personal data from the following sources:

  • Directly from you: For instance, when you use or access the Services, communicate or transact through the Website, or submit personal data online in connection with the Services.
  • Our vendors: For example, when our vendors provide us with personal data related to you in the course of delivering their services to us.
  • Cookies and similar technologies: When you visit the Website, we may use first- and third-party tools (e.g., cookies) to facilitate and personalize your experience on the Website or other online services. For more information, see the section titled “Cookies and other similar technologies.”
  • External sources: Such as publicly available government records and our business partners, in connection with co-marketing or other joint marketing campaigns. This does not include our vendors.

4. What personal data does ezyHire collect and why does ezyHire collect it?

The personal data we collect depends on the context of your interactions with ezyHire, the choices you make (including your privacy settings), the products and features you use, your location, and applicable law. Please note that the specific pieces of personal data we have collected about you may vary depending on the nature of your interactions with us and may not include all of the examples listed below.

Sensitive personal data, including information from government-issued identification (e.g., social security number, driver’s license, state identification card, or passport number) and biometric information (e.g., faceprints, including facial mapping and scans of digitized images; and fingerprints, including scans of digitized images). To provide services you request, including operating and maintaining our Products.

We may also collect, use or disclose all categories of personal data described above for other purposes authorized by applicable laws, including:

  • To prevent potential loss of life or serious injury and to ensure the personal safety of ezyHire staff, Service users, visitors, or the general public;
  • To identify, investigate, and mitigate fraud or any security and integrity concerns;
  • In connection with corporate transactions or proceedings, such as mergers, financing, acquisitions, bankruptcies, dissolutions, or the transfer, divestiture, or sale of all or part of our business or assets;
  • To ensure the security and integrity of our Services are effectively operated and maintained;
  • To safeguard our rights, properties, our affiliates, or third parties, including enforcing our agreements, terms, and policies.

If you use our Products, you can voluntarily share your personal data, including biometric information, to verify your identity, authenticate your information, and help prevent fraud while using our Customers’ websites or mobile applications. We gather your personal data via the photographic functionality on the relevant hardware whenever you start capturing a photograph, and/or if you choose to manually input it.

5. How does ezyHire disclose personal data?

We will not share your opt-in consent or phone numbers with any affiliated businesses or third parties.

We may disclose your personal data to the recipients specified in this section.

Service Providers: These vendors assist us in delivering the Services or executing business functions on our behalf. They will process your personal data solely for the purposes outlined in this Privacy Notice. These vendors include:

  • Providers of hosting, technology, and communication services.
  • Consultants specializing in security and fraud prevention.
  • Vendors offering support and customer service.

Analytics Partners: These parties offer insights into web traffic and usage of the Website. They include:

  • Companies that analyze how users discover or are referred to the Website.
  • Companies that monitor user interactions and engagement with the Website.

Business Partners: These parties work with us to provide various services. They include:

  • Businesses with which you have a relationship.
  • Companies that we collaborate with to deliver joint offerings or opportunities.

Business Transfers: Your personal data may be transferred to a third party (and their agents and advisors) in the event of a merger, acquisition, bankruptcy, financing, dissolution, transfer, divestiture, sale of all or part of our business or assets, or any other transaction where that third party takes control of our business, in whole or in part.

Consent: We may share your personal data with others if we have received your consent for such disclosure, including situations where you explicitly authorize us to share your personal data with our business partners.

6. Cookies and other similar technologies

In ezyHire and our vendors may utilize cookies and other similar technologies, such as pixels, tags, web beacons, and trackers (collectively referred to as “Cookies”) on the Website. We may use Cookies for various purposes, including to:

  • Store information to ensure the Website operates effectively.
  • Facilitate your access to and navigation of the Website more smoothl.;
  • Allow our servers to recognize your login credentials and preferences, eliminating the need to re-enter the same information during subsequent visits.
  • Provide insights on how and when you access and utilize our Services, including data on the pages you viewed, links you clicked, and your interactions with our content across visits.
  • Personalize your browsing experience by displaying information that is more relevant to you.
  • Deliver tailored advertisements and monitor advertising campaigns.

We may employ third-party technologies, such as the Meta Pixel and Hotjar, to track your activity on the Website. These tools assist us in advertising and analyzing how you interact with the Website, including the features you use, your navigation patterns, and your click/touch, movement, scroll, and keystroke behaviors. These technology providers and advertisers may utilize, store, or access cookies and other tracking methods to gather information from the Website and other online spaces. If you wish to adjust your privacy and advertising preferences with Meta, please log into your Meta account and go to your account settings.

We may also use web analytics services like Google Analytics to better understand how users engage with our Website. This information helps us implement Google advertising features, such as dynamic remarketing, interest-based advertising, and reporting on demographics and interests. You might be able to opt-out of certain interest-based advertising through your browser or mobile device settings. Furthermore, to opt-out of interest-based ads from companies that participate in the Digital Advertising Alliance or the European Interactive Digital Advertising Alliance opt-out programs.

Please be aware that we or other parties may collect personal data about your online activities over time and across different devices and websites when you access the Website.

Some browsers have integrated “Do Not Track” (DNT) features that signal to the websites you visit that you do not want to be tracked. Because there is no universal understanding of how to interpret DNT signals, our Website does not currently respond to them. Instead, you can use the various tools mentioned above to manage data collection and usage.

7. Your choices

You have the right to opt-out of any marketing communications we send you at any time. To stop receiving marketing emails, simply follow the unsubscribe instructions included in those emails. 8. Data security

We strive to safeguard your personal data from unauthorized access, use, and disclosure by implementing suitable physical, technical, organizational, and administrative security measures tailored to the type of personal data and its processing. Additionally, you can help protect your personal data by carefully choosing and securing your password and/or other sign-in methods, restricting access to your computer or device and browser, and logging out after accessing your account. While we take steps to secure your account and the personal data in our records, please understand that no method of data transmission over the internet or data storage is entirely secure.

9. Data retention

We retain your personal data for as long as necessary to fulfill the purpose(s) for which it was collected, in accordance with applicable laws and regulations. For instance, we will keep your personal data for as long as you maintain an open account with us or as required to provide our Services. In certain situations, we may retain personal data for a longer period if we have a legitimate ongoing need, such as to comply with our legal, tax, or accounting obligations, resolve disputes, or collect outstanding fees, or if permitted or mandated by applicable laws, rules, or regulations.

Retention periods can vary significantly depending on the type of data and the context of the services provided. Criteria influencing these periods may include whether your personal data is essential for managing our operations, maintaining your relationship with us, or fulfilling any other purpose for which it was collected; whether it is necessary for a disclosed purpose compatible with the context of collection; whether it is required to protect or defend our rights or property; or whether we are otherwise obligated or authorized to retain your personal data under applicable laws or regulations (such as in Illinois, where the retention period is three years, and in Texas, where it is one year). If your personal data is used for multiple purposes, we may retain it until the purpose with the longest retention period expires.

10. Personal data of children

We do not intentionally collect or seek personal data from children under the age of 18. If you are a child under 18, please refrain from registering for or using our Services or sending us any personal data. If we discover that we have collected personal data from a child under 18, we will delete that information in compliance with applicable laws. 11. Additional information for illinois residents

If you are an Illinois resident whose biometric information we have collected, we may retain your biometric data only until one of the following occurs, unless required otherwise by law or our agreements with Customers: (i) the original purpose for collecting the biometric information has been fulfilled; or (ii) three years have passed since your last interaction with ezyHire, in compliance with Illinois law.

If you are a California resident who uses our Products or interacts with us on an individual or household level, the following information applies to you and serves as a supplement to the information provided in this Privacy Notice. In the case of any discrepancies between this section and the Privacy Notice above, this section will take precedence for California residents.

In this section, references to “personal data” are synonymous with “personal information” as defined under California law.

A. California Consumer Privacy Act (“CCPA”)

Your Privacy Rights. Under the CCPA, California residents are entitled to the following rights:

  • Right to Access/Know: You have the right to request disclosure of the following personal data:
    • The categories and specific pieces of personal data we have collected about you in the last 12 months.

  • Right to Delete: You have the right to request the deletion of any personal data we have collected from you, with certain exceptions.
  • Right to Correct: You have the right to request corrections to any inaccurate personal data we have collected about you. We may ask for documentation related to your request. Upon receiving a verifiable request to correct inaccurate personal data, we will make commercially reasonable efforts to rectify the information.
  • Your Opt-Out Rights: We sell and share personal data for valuable consideration (not in monetary exchange). This data is primarily collected through our use of Cookies and shared with our advertising partners and analytics vendors to support our cross-context behavioral advertising efforts. The categories of personal data we sell and share include:

  • You can opt out of the sale and sharing of your personal data via Cookies through our Cookie preference center by clicking on the “Do Not Sell or Share My Personal Information” link in the footer of our Website.

  • Exercising Your Rights: To exercise your rights to access/know, delete, and/or correct your personal data, you or an authorized agent must submit a request that:

B. California Shine the Light Law

California law allows customers in California to request specific information about how their personal data is shared with third parties and, in some instances, affiliates, particularly when such data is shared for the direct marketing purposes of those third parties or affiliates. We do not share personal data with third parties or affiliates for their own direct marketing purposes. Any request must include your name and the phrase “California Shine the Light Privacy Rights Request” in the first line of the description. If the request is sent by mail, it should also include your street address, city, state, and zip code.

Please be aware that the “Shine the Light” rights and the rights provided under the CCPA are established by different laws and must be exercised separately.

13. Additional information for nevada residents

As a resident of Nevada, you have the right to opt out of the sale of specific personal data to third parties. Please note that, as defined in Nevada Revised Statutes Chapter 603A, we do not currently sell your personal data.

If you are a resident of the European Union (“EU”), United Kingdom (“UK”), Liechtenstein, Switzerland, Norway, or Iceland, you may have additional rights regarding your personal data under the EU General Data Protection Regulation (the “GDPR”), the UK GDPR, and other European privacy laws, as detailed below. For residents of the European Economic Area (“EEA”), the UK, or Switzerland, the controller of your personal data (excluding processing done on behalf of our Customers) is ezyHire.

A. Legal Basis for Processing Personal Data

We will only process your personal data when we have a valid legal basis for doing so. The legal basis we rely on depends on the type of personal data involved and the specific context in which it is collected. Generally, we depend on the following legal bases:

Contractual Necessity: We process your personal data out of “contractual necessity,” which means that we need to handle the data to fulfill our contract with you, such as delivering the Services through our Customers’ applications and/or websites. If we process personal data based on contractual necessity, not providing the required data may prevent you from using some or all parts of the Services that depend on that personal data.

Legitimate Interest: We may also process your personal data when we believe it supports our legitimate interests or those of others, provided that these interests do not outweigh your data protection interests or fundamental rights and freedoms. Examples of these legitimate interests include:

  • Providing, customizing, and improving the Services;

In certain situations, we may also require additional information from you, which could include personal data, to verify your identity and understand the nature of your request.

C. Transfers of personal data

ezyHire is a United States-based company with service providers located in the U.S. and other countries. This means that your personal data may be transferred to and processed in countries outside of your own. These countries may have data protection laws that differ from those of your country, and in some instances, may not offer the same level of protection. We implement appropriate safeguards to ensure that your personal data is protected in accordance with this Privacy Notice and applicable data protection laws. If you are located in the EEA, UK, or Switzerland, these safeguards include transferring your personal data to a country deemed by relevant authorities to provide an adequate level of protection, or by using Standard Contractual Clauses with our Customers, service providers, and partners. If you are located in Australia or are using our services or interacting with ezyHire in Australia, the following information applies to you. This section supplements, overrides, and extends the scope of this Privacy Notice. In addition to this section, the rest of the Privacy Notice also applies to you, except for those parts specifically limited to jurisdictions outside of Australia or that conflict with the details outlined here. A. Are we a data controller or data processor?

In certain privacy frameworks we adhere to, our role in handling your personal data may differ based on whether we are classified as a "data controller" or "data processor." When we provide identity verification services to our Customers, we typically act as a data processor. However, in the context of Australian privacy law, this distinction is not applicable to you. We have obligations regarding your personal data, even when we function as a "data processor." The section below on data processors explains how we collect and process personal data on behalf of our Customers when providing our Services. However, the specifics of these practices are dependent on the data collection and usage policies of our Customers.

B. Information we collect as a Data Processor

When you use ezyHire’s services in certain situations, we may act as a data processor on behalf of our Customers, as defined by specific privacy laws. In such cases, the way we collect your personal data, the types of personal data collected, and the third parties to whom we may disclose this data remains consistent. For details on the personal data we collect and how we disclose it when acting as data processors, refer to the sections titled “What personal data does ezyHire collect and why?” and “How does ezyHire disclose personal data?”

C. Your rights under Australian privacy law

We will take reasonable measures to provide you access to your personal data unless there are legitimate circumstances that prevent us from doing so.

If we determine that your personal data is inaccurate, outdated, incomplete, irrelevant, or misleading, we will take steps to correct it. In cases where the data has been shared with third parties, we will make reasonable efforts to inform them of the correction or update. You acknowledge that, when you request a correction, we may need to verify your identity or the accuracy of the data, which could involve confirmation with third parties.

If you believe we have breached the Australian Privacy Principles, please reach out to us using the contact details provided above. We will promptly assess the issue and propose appropriate resolution processes. This review will be conducted as swiftly as possible, and in any case, within 30 days.

D. Direct Marketing in Australia

When we use your personal data to send marketing and promotional materials, you will be given the option to opt-out of receiving such communications. If you do not opt out, it will be considered that you have given consent to continue receiving similar communications in the future.
